NAGPUR: A marathon five-hour hearing on disqualified Congress MLA Sunil Kedar’s plea before a sessions court for a stay on conviction and bail in the Rs 150 crore Nagpur Nagpur District Central Cooperative Bank (NDCCB) scam, concluded Tuesday. A decision on bail is likely on Wednesday.
Kedar’s counsel vehemently argued for a stay on his conviction, apart from suspension of the five-year jail term spelt by the lower court last week.Suspension of the sentence would ensure Kedar’s release on bail, and a stay on conviction would reverse Kedar’s disqualification as MLA under the Representation of the People Act.
His lawyer Devendra Chauhan cited the Supreme Court’s observations in cases related to Rahul Gandhi and Navjot Singh Sidhu, where it was stressed that disqualification post-conviction could have serious ramifications and affect people’s representation in a constituency.
